TERMS & CONDITIONS

 

  1. The Seller confirms that they are the legal owner of the vehicle and have full authority to sell it.
  2. The vehicle is sold free from all finance, charges, and encumbrances.
  3. The Buyer acknowledges they have inspected the vehicle and are satisfied with its condition and description.
  4. For consumer sales, the vehicle is supplied in accordance with the Consumer Rights Act 2015, which provides the Buyer with statutory rights regarding quality, fitness for purpose, and description.
  5. Any warranty provided by the Seller or a third party will be subject to its own terms and conditions, which will be supplied separately if applicable.
  6. The Seller accepts no liability for failure or defect arising from misuse, neglect, accident damage, or wear and tear occurring after delivery.
  7. The Seller shall not be liable for any indirect loss or consequential damage suffered by the Buyer.
  8. Title and ownership of the vehicle will pass to the Buyer only upon full payment of the agreed price.
  9. Any deposits paid are non-refundable unless otherwise agreed in writing.
  10. If the Buyer exercises their right to reject the vehicle under Section 24 of the Consumer Rights Act 2015, the Seller reserves the right to make a reasonable deduction from any refund to reflect the use that the Buyer has had of the vehicle after delivery. The deduction will normally be calculated on a per-mile basis, applying a rate of 30p per mile, multiplied by the mileage driven by the Buyer between delivery and the date of rejection. This rate is intended to represent a fair and reasonable estimate of depreciation and use, in line with industry guidance and the age and value of the vehicle. The Seller will provide written details of how any deduction has been calculated at the time of refund. This clause does not affect the Buyer’s statutory rights.
  11. For trade sales, the Buyer acknowledges that the vehicle is sold as seen, tried, and approved, without warranty, and that the Consumer Rights Act 2015 does not apply.
  12. The Seller will process personal data of the Buyer in accordance with the UK GDPR and Data Protection Act 2018 solely for the purposes of completing this transaction.
  13. This agreement is governed by and shall be construed in accordance with the laws of England and Wales.
  14. Restocking Fee: Any vehicle returned, rejected, or cancelled by the Buyer may be subject to a restocking fee. The restocking fee will be calculated at the Seller’s discretion, taking into account administrative costs and any reduction in the vehicle’s value, and will be deducted from any refund payable to the Buyer.
  15. Valeting / Reconditioning Fee: If the vehicle is returned or rejected, the Seller reserves the right to apply a valeting or reconditioning fee to cover the cost of cleaning, inspecting, and preparing the vehicle for resale. This fee will be deducted from any refund due to the Buyer.
  16. Additional Ownership or Administrative Fee (£200): The Seller may charge an additional fee to cover the administrative cost associated with transferring ownership or registering the vehicle following a return or rejection. This fee will be applied in addition to any restocking or valeting fees.
  17. Combined Deductions: Where applicable, the Seller may apply any combination of the fees described in clauses 14–16. All fees will be communicated in writing to the Buyer, with an itemised breakdown, at the time of refund.
  18. 18. No Impact on Statutory Rights: Nothing in clauses 14–17 affects the Buyer’s statutory rights under the Consumer Rights Act 2015. Any fees applied will be fair, reasonable, and in proportion to the use or depreciation of the vehicle.
